Please read these terms carefully before using the NHSCC LMS platform

1. Acceptance of Terms

By accessing or using the NHSCC Learning Management System at lms.nhscc.in (“Platform”), you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not access or use the Platform. These Terms constitute a legally binding agreement between you and the National Healthcare Supply Chain Council (“NHSCC,” “we,” “us,” or “our”), a not-for-profit organization registered in India.

These Terms apply to all users of the Platform, including learners, instructors, organizational administrators, corporate users, and visitors.

2. Definitions

  • “Platform” refers to the NHSCC LMS website at lms.nhscc.in and all associated services, applications, and content.
  • “User” refers to any individual who accesses or uses the Platform, including learners, instructors, and administrators.
  • “Course” refers to any educational content, training program, module, assessment, or certification program available on the Platform.
  • “Instructor” refers to any individual or entity that creates, uploads, or delivers course content on the Platform.
  • “Content” refers to all text, images, videos, audio, assessments, certificates, and other materials available on the Platform.
  • “Organization” refers to any hospital, corporate entity, institution, or group that enrolls users through a corporate or organizational account.

3. Account Registration & Eligibility

To access certain features of the Platform, you must create an account. By registering, you represent and warrant that:

  • You are at least 18 years of age, or have the consent of a parent or legal guardian.
  • All information you provide during registration is accurate, current, and complete.
  • You will maintain and promptly update your account information to keep it accurate.
  • You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
  • You will immediately notify us of any unauthorized use of your account.

NHSCC reserves the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

4. Course Enrollment & Access

Upon successful enrollment and payment (if applicable), you will receive access to the course content for the duration specified. Course access terms include:

  • Individual enrollments grant access to the enrolled user only. Account sharing is strictly prohibited.
  • Course access duration varies by course and is specified on the course detail page. Unless stated otherwise, access is granted for 12 months from enrollment.
  • Corporate and organizational enrollments are governed by separate agreements and may include bulk access, progress reporting, and custom terms.
  • NHSCC reserves the right to modify, update, or retire course content at any time to ensure accuracy and relevance.
  • Completion of courses, assessments, and certification requirements is the sole responsibility of the enrolled learner.

5. Payment & Pricing

All prices on the Platform are listed in Indian Rupees (INR) unless otherwise stated. Payment terms include:

  • Payment is required at the time of enrollment for paid courses. We accept major credit/debit cards, UPI, net banking, and other methods via our payment processors.
  • All prices are inclusive of applicable Goods and Services Tax (GST) unless explicitly stated otherwise.
  • NHSCC reserves the right to change course pricing at any time. Price changes do not affect existing enrollments.
  • Promotional discounts and coupon codes are subject to specific terms and expiration dates.
  • For corporate and organizational billing, invoicing and payment terms are governed by separate commercial agreements.

Refunds are governed by our separate Refund Policy.

6. Intellectual Property

All content on the Platform — including but not limited to course materials, videos, assessments, text, graphics, logos, icons, images, audio clips, software, and the compilation thereof — is the property of NHSCC or its content licensors and is protected by Indian and international copyright, trademark, and intellectual property laws.

  • You are granted a limited, non-exclusive, non-transferable, revocable license to access and use course content solely for your personal, non-commercial educational purposes.
  • You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Platform content without prior written permission from NHSCC.
  • Screen recording, video downloading, content scraping, or any form of unauthorized copying is strictly prohibited and may result in immediate account termination and legal action.
  • Certificates and credentials issued by NHSCC remain the intellectual property of NHSCC and may be revoked if obtained through fraudulent means.

7. User Conduct

You agree not to engage in any of the following prohibited activities:

  • Sharing your account credentials with others or allowing multiple individuals to use a single account.
  • Copying, distributing, or selling course content in any form.
  • Using the Platform for any unlawful purpose or in violation of any applicable laws or regulations.
  • Harassing, threatening, or intimidating other users, instructors, or NHSCC staff.
  • Uploading or transmitting viruses, malware, or any malicious code.
  • Attempting to gain unauthorized access to the Platform, other accounts, or NHSCC systems.
  • Using automated tools, bots, scrapers, or similar technology to access the Platform.
  • Submitting false, misleading, or fraudulent information.
  • Impersonating another person or entity.

8. Certificates & Credentials

NHSCC may issue certificates of completion or achievement upon successful completion of courses and assessments. Certificate terms include:

  • Certificates are issued based on course-specific criteria including minimum assessment scores, completion of all required modules, and meeting attendance requirements where applicable.
  • Certificates are verifiable through the Platform using unique verification codes.
  • NHSCC reserves the right to revoke certificates obtained through dishonest means, including cheating on assessments, plagiarism, or misrepresentation of identity.
  • Certificates represent completion of educational coursework and may not constitute professional licensing or regulatory certification. Learners are responsible for understanding the recognition and validity of certificates in their respective jurisdictions and professions.

9. Limitation of Liability

To the maximum extent permitted by applicable law:

  • The Platform and all content are provided on an “AS IS” and “AS AVAILABLE” basis without warranties of any kind, whether express or implied.
  • NHSCC does not guarantee that courses will meet your specific requirements, that the Platform will be uninterrupted or error-free, or that defects will be corrected.
  • NHSCC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Platform.
  • NHSCC’s total liability for any claim arising from these Terms or use of the Platform shall not exceed the amount paid by you for the specific course giving rise to the claim.
  • Course content is for educational purposes and does not constitute professional medical, legal, or financial advice. NHSCC is not liable for decisions or actions taken based on course content.

10. Indemnification

You agree to indemnify, defend, and hold harmless NHSCC, its officers, directors, employees, agents, instructors, and affiliates from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising from: (a) your use of the Platform; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) your user content or submissions.

11. Termination

NHSCC may suspend or terminate your account and access to the Platform at any time, with or without cause, and with or without notice, for conduct that NHSCC believes violates these Terms or is harmful to other users, NHSCC, or third parties, or for any other reason at NHSCC’s sole discretion. Upon termination, your right to access the Platform and any enrolled courses will immediately cease. Sections that by their nature should survive termination shall survive, including intellectual property, limitation of liability, indemnification, and dispute resolution.

12. Dispute Resolution & Governing Law

These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or relating to these Terms or the use of the Platform shall be subject to the exclusive jurisdiction of the courts in New Delhi, India. Before pursuing formal legal action, both parties agree to attempt to resolve disputes through good-faith negotiation for a period of at least 30 days.

13. Modifications to Terms

NHSCC reserves the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Platform at least 15 days before they take effect. Your continued use of the Platform after changes constitutes acceptance of the modified Terms. If you disagree with the changes, you must discontinue use of the Platform.

14. Severability

If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
